Uber & Lyft Accident Lawyer in Miami

Personal Injury & Employment Law for Rideshare Crash Victims in Miami

Rideshare accidents aren’t straightforward car accident claims. Depending on whether the driver’s app was active, who was in the vehicle, and whose insurance policy applies, the same crash can involve multiple insurers and more than one legal theory. At Remer, Georges-Pierre & Hoogerwoerd, PLLC, our personal injury practice handles Uber and Lyft accident claims throughout Miami and Florida, and our employment law background puts us in a position to address gig worker classification questions that other personal injury firms can’t.

If you were hurt in a rideshare crash, call us at (877) 757-2828. Initial consultations are free, and we work on contingency, so there’s no fee unless we recover compensation for you.

Who Can Bring a Rideshare Accident Claim

You don’t have to have been a passenger to pursue a claim after an Uber or Lyft accident. People injured in these crashes include passengers inside the rideshare vehicle, drivers and passengers in other cars, pedestrians and cyclists struck by a rideshare vehicle, and the rideshare drivers themselves.

Uber and Lyft classify their drivers as independent contractors rather than employees, a distinction that affects both the driver’s coverage options and whether the company can be held directly responsible for a driver’s negligence. For drivers who were injured while working and also have questions about their classification status, our employment law practice can address the injury claim and those worker-status questions together.

Florida’s Tiered Rideshare Insurance Rules

Florida Statute 627.748, which governs transportation network companies, sets minimum insurance requirements that shift based on the driver’s app status at the moment of the crash. Understanding which tier applies is the first step in determining who pays.

  • App off: Only the driver’s personal auto insurance applies.
  • App on, waiting for a request: The rideshare company must provide at least $50,000 per person and $100,000 per incident in bodily injury coverage, plus $25,000 in property damage.
  • Ride accepted through trip completion: At least $1 million in primary liability coverage is required from the moment the driver accepts a request until the passenger exits.

This coverage can be satisfied by the driver’s policy, the rideshare company’s policy, or a combination of both. If the driver’s personal policy has lapsed or doesn’t meet the statutory minimum, the rideshare company’s insurer must step in from the first dollar. Florida also permits personal auto insurers to exclude coverage while a driver is logged into a rideshare app, which can leave gaps the driver’s own policy won’t fill.

Common Causes & High-Risk Areas in Miami

App-based driving creates distraction patterns that differ from typical commuter traffic. Rideshare drivers frequently switch between navigation apps, monitor incoming requests, and pull over abruptly in high-demand zones, all of which raise crash risk. Pick-up and drop-off stops in busy areas often involve sudden lane changes that other drivers don’t anticipate.

Heavy-traffic corridors like I-95, US-1, and the MacArthur Causeway see dense, fast-moving traffic alongside frequent rideshare activity, a combination that makes those stretches particularly hazardous for everyone on the road.

Steps to Take After an Uber or Lyft Accident

The actions you take in the hours and days after a rideshare crash can affect your claim significantly. Even when injuries don’t seem serious at first, getting medical attention promptly creates a record connecting your condition to the crash. After that, these steps matter:

  • Call law enforcement and obtain a copy of the police report.
  • Report the crash through the Uber or Lyft app to preserve trip data showing the driver’s app status at the time of impact.
  • Document the scene with photos and collect contact information from any witnesses.
  • Avoid recorded statements to any insurance adjuster before speaking with an attorney.

When you contact our firm, we aim to have a personal injury attorney meet with you within hours of your call. When time-sensitive evidence needs to be preserved, we can deploy an investigator to the accident scene within 24 hours. Sign-up meetings can take place at our Miami office or, if you’re recovering, at your home, workplace, or hospital.

What You Can Recover & Florida’s Legal Rules

A rideshare injury claim in Florida can include compensation for medical expenses, lost wages, property damage, and pain and suffering. Pain and suffering covers anxiety, depression, and loss of enjoyment of life, not just physical symptoms. Permanent injuries, significant loss of an important bodily function, or disfigurement support claims for the full scope of those losses.

Florida’s Personal Injury Protection (PIP) insurance covers up to $10,000 in medical bills and lost wages regardless of fault, but that amount rarely covers serious injuries. Two additional rules shape every claim. First, Florida follows a modified comparative negligence standard: if you’re found more than 50 percent at fault for the crash, you can’t recover compensation, and any award is reduced by your share of fault. Second, you generally have two years from the date of the accident to file a personal injury lawsuit, and two years from the date of death for a wrongful death claim. Missing that deadline typically ends the case.
