Florida’s Motorcycle Helmet Law & Your Claim
Florida Statute 316.211 requires riders under 21 to wear a helmet meeting Federal Motorcycle Vehicle Safety Standard 218. A rider 21 or older may ride without a helmet only if covered by an insurance policy providing at least $10,000 in medical benefits for motorcycle crash injuries. Every rider, regardless of age, must wear eye protection.
Riding without a helmet doesn’t automatically bar a claim, but insurers often argue it contributed to the severity of injuries. Florida’s Comparative Negligence Rule & Filing Deadline
Florida uses a modified comparative negligence standard. Under Florida Statute 768.81(6), amended by HB 837 effective March 24, 2023, a claimant found more than 50% at fault for their injuries generally cannot recover any damages. If fault is assigned at 50% or less, recoverable damages are reduced by that percentage. Insurers use this rule aggressively against motorcyclists, which is why controlling the early evidence record matters.
The filing deadline carries equal weight. Under Florida Statute 95.11(4)(a), most personal injury negligence claims arising on or after March 24, 2023 must be filed within two years of the date of injury. Missing that deadline generally results in a court dismissing the claim entirely, which can bar recovery.
